just a heads up, if you are classifying people as ICs you are not an employer. That is done to avoid taxes and WC, and the Gov knows it, it's a great way to get audited. IC agreements, contracts, job descriptions, etc.. are almost worthless. Walmart would hire nothing but ICs if it was possible. ICs are defined by the IRS, you are expected to get it right the first time, and there are no do-overs, just a whole lot of liability. At the bare minimum an IC must be registered with the SOS and carry their own liability insurance. If they're not a SP, LLC or C they work for you. I know a guy who is paying an IC monthly for the last 3 years (and for who knows how much longer) after the guy claimed a back injury and reported it to CDLE. They don't need to say anything to you, just fill out a form online and let the gov get you. The injury is very suspect, but without WC insurance no one investigated the injury, they just held my buddy liable. It is a HUGE can of worms to hire ICs, the little bit you save on taxes and WC is nothing compared to the liability you incur. You also give up corporate protection and become personally liable when you don't follow the rules, your personal earnings can be attached for the rest of your life.

not trying to be harsh, I admire your entrepreneurial spirit, I didn't have my first business until I was 26, you're way ahead of me. its just a big deal and your post here alone is enough to get you investigated, any one at any time can report you for no reason with a just a couple of clicks. It doesnt matter if you are an LLC, your subs have to be registered or you are actually hiring them with all the responsibilities of such. The Colorado State Supreme Court made a big decision on this last year, and Colorado is one of the few states that gives you federal penalties as well. For example, if someone hires a plumber that plumber can subcontract to any plumber who is registered to do business with the SOS, but not to an individual who isn't registered, that is not a business entity it is an employee. The second the plumber signs a subcontractor agreement with a non-registered person he has actually hired that person and misclassified him. It's a $5000.00 fine for the first misclassified employee, $25,000.00 each emloyee after that. https://www.colorado.gov/pacific/cdle/node/20181 And the state figures out the first day of employment and you owe WC insurance premiums plus fees retroactively back to that date. That's if nothing goes wrong and you just get caught. If something goes wrong, your WC liability goes up to 150% of what it would be with insurance, but you get to pay it out of pocket. Then there are also criminal charges, and you can be prevented from doing business in CO for years, meaning you get a job or three to pay what you now owe. It is a really big deal.
